| The Credit Card Accountability Responsibility and Disclosure Act of 2009 (the 'CCARD' Act) is now law in the United States. It became effective on August 22, 2010 but the rules applying to gift cards were extended by Congress until January 31, 2011. Nevertheless, issuers of gift cards must become compliant with the stipulations of the law, and merchants, retailers and businesses must become familiar with the regulations and, if necessary, modify their existing gift card program. Gift cards may not have expiration dates of less than five years. Dormancy, inactivity and any other service fees must be clearly disclosed to the cardholder. Other rules may apply. State laws that are considered more protective of consumers supersede the CCARD Act rules. Merchants, retailers and businesses that offer a gift card program, and are unsure about the legality of their program policies should contact their legal counsel for additional information. |
